  1. Other applicable terms

The following additional terms and policies apply to your use of the Website:

  1. Website access

The Website is available free of charge; you do not need an account or login details to access its contents. We therefore do not guarantee that our site, or any content on it, will always be available or uninterrupted. Availability of all or any part of the Website may be suspended, withdrawn or restricted at any time. We will try to give reasonable notice of any such suspension or withdrawal.

  1. Website content

We are the owner or rightsholder of all intellectual property rights contained on the Website, and its content. All such rights are reserved. Our trademarks in any of our logos on the Website are registered to us.

Where we display third party logos, brand names, products or services, we do so with the permission of the relevant rightsholder(s). Such rights do not belong to us.

You must not use any part of the Website or its content for commercial purposes.

We will ensure that we comply with all applicable laws and good industry practice in relation to operating our Website, including the Association of British Pharmaceutical Industry Code of Practice (as applicable).

  1. Your personal data

You may provide us with your personal data when you wish to sign up to our mailing lists to find out more about our services, and those of our partners. We will also capture your personal data when you browse the Website. Details of the personal data we process when you use the Website are set out in our privacy policy.

  1. Third party websites & products

The Website connects you with independent third party medical product and service providers through our product review features. Any products and services from those third parties, including any statements made in respect of such products, are provided by them and not by us and will always be subject to their terms and conditions. We do not sell or distribute such third party products at any time.

The Website provides information required by applicable regulations to identify those third party providers. Information displayed on the Website is based on information we receive, which may be different to who you receive the services from.

We display reviews of third party products on an independent basis. We also undertake clinical trials with the relevant providers to review the products. Such reviews constitute our opinion based on information we have obtained from a wide range of sources, some of which are publicly available. They are not intended to influence, encourage, incentivise or discourage you from choosing a particular product or provider. Other sources include information contained in research papers and manufacturer’s or supplier’s websites that we consider to be appropriately accredited, qualified and reliable. We may withdraw any third party product review at any time, without notice.

Where we display any third party pricing information, these are estimated costs only and are taken from the list prices on the manufacturer’s or distributor’s website at the time of review, which may not be accurate.

The Website may direct you to third party websites. We are not responsible for third party content, or any link in any linked website or any transmission from any linked website.

We do have limited, informal arrangements with a small number of third party partners who are selected on merit based on their product ratings, and we do rank these  “partners” so that their products or services may receive preferential ranking. We do not receive payments to rank such products, but we do sometimes receive product samples and/or commitments to contribute to Website content as incentives to reference, list or display their product or service.

  1. Linking to the Website

Only linking is permitted; framing of the Website is not. You may link to our Website’s homepage only on your own blog, social media profile or website, provided you do so fairly, lawfully and without damaging our reputation. You must not establish any link in such a way as to suggest any form of association, approval or endorsement on our part (where none exists). You must not frame any part of the Website on any other site, blog or page.

Linking permission can be withdrawn at any time, without notice.

  1. Disclaimer

We are not responsible for any advice given to you, or products you acquire from, third parties, or any decision you make in respect of such products or services or the third party providing them to you in response to any information you take from the Website. We are also not responsible for third party compliance with applicable data protection, health regulatory, marketing or consumer protection laws when you engage with them.

Including and/or referencing any third party product or service on our Website does not imply that any member of our group of companies has endorsed, approved or otherwise recommended the third party, or their product or service, to you for any specific purpose. We also give no guarantee that the products can be lawfully sold and do not infringe any third party’s intellectual property rights (i.e. counterfeit goods).

We do not give any warranties (express or implied) relating to satisfactory quality, fitness for use, non-infringement, compatibility, security and/or accuracy in relation to the Website. Use of the Website is therefore entirely at your own risk.

As stated, this Website is available for use on an “as is” basis, free of charge. We will not be liable for any losses or damages that you may incur through your use of the Website (other than any such losses that cannot be excluded or limited by applicable law).

  1. General

These Terms apply to you as a user of the Website and a consumer of its content. You cannot assign the Terms to anyone else. However, we may assign the Terms freely in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise.

These Terms are enforceable by us against use for any breach of them. A person who is not a party to these Terms shall not have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any such Terms. Any failure by us to insist upon strict performance of any part of it, or delay in or failure to exercise any rights or remedies to which we are entitled shall not constitute a waiver of such rights or remedies.

If any provision of these Terms is invalid, illegal or unenforceable for any reason, such provision shall be severed from the Terms without affecting the enforceability or validity of the remainder.

The English courts will have exclusive jurisdiction over any claim arising from, or related to, your use of and access to the Website. We reserve the right to bring proceedings against you for breach of these Terms in your country of residence, or any other relevant jurisdiction.
